The second paragraph of Article 22 of the LSSI establishes:

 

  • 2. Service providers can use storage devices and data recovery target terminal equipment, provided that they have given their consent after providing them with clear and comprehensive information on their use, in particular on the purposes of the processing of data in accordance with the provisions of Law 15/1999, of December 13, Protection of Personal Data with.
  • Where technically possible and effective, the consent of the recipient to accept the treatment of data may be provided by using the appropriate settings of a navigator or other application, provided that it should proceed with its configuration during installation or update through an express action for this purpose.

They are waived from compliance regarding the obligations under Article 22.2 of the LSSI cookies used for any of the following purposes:

Only allows communication between the user equipment and the network.
It strictly provides a service explicitly requested by the user.
In this respect the Article 29 Work Group in its 4/20123 Pronouncement has interpreted the exception among those cookies that have following aim:

 

  • "User input" cookies
  • Cookie authentication or user identification (session only)
  • User security Cookies
  • Media player session cookies
  • Session cookies for load balancing
  • User interface customised cookies
  • Supplement Cookies (plug-in) to share social content


Thus, it can be understood that these cookies are excluded from the scope of Article 22.2 of the LSSI, and therefore it would not be necessary to inform and obtain the consent for their use.
On the contrary, it is necessary to inform and obtain consent for the installation and use of any other type of cookies, both first and third party, session or persistent, remaining pursuant to Article 22.2 of the LSSI and, within the guidelines that will be helpful in this guide.

  • Technical cookies: They are those that allow the user to navigate through a website, platform or application and use of the different options or services that exist on the same. (e.g. identify the session, access to restricted parts, remember the elements of an order, make an application for registration or participation in an event, etc.).
  • Cookies analysis: They are those that allow the responsible party thereof, monitoring and analysing the behaviour of website users to which they are linked. The information gathered through such cookies is used in measuring the activity of web, application or platform sites for profiling navigation users of these sites, applications and platforms, in order to make improvements based on user data analysis carried out by users of the service.(e.g. visitor statistics like Google Analytics or similar)

  • Own cookies: They are those that are sent to the user's terminal equipment from a computer or domain managed by the editor itself and from which the service requested by the user is provided. (e.g. identifying the user session on a web page)
  • Third party cookies: They are those that are sent to the user's terminal equipment from a computer or domain that is not managed by the publisher, but by another entity that treats data obtained through the cookie. (e.g. the poster is a banner on a website, box fans on a social networking site, etc.)
